Kayo is a vehicle management solution used to manage the tracking and performance of your vehicles. This Beta Privacy Policy applies to personal information obtained through the Kayo mobile application (the “App”) and the global positioning system tracking device (the “Device”, and together with the App, the “Services”), which is operated by 1898 Ventures, LLC (“1898 Ventures”, “we”, “us”, “our”). This Privacy Policy explains our practices and governs the use of personal information 1898 Ventures collects from you or about you through the Services.
For information on our collection of geolocation, see section 1.A., “Information about You that You Provide via the App”, and section 1.B., “Information Collected from the Device”.
By further downloading, using, creating an account, or registering on the App you agree to this Privacy Policy and consent to the collection, use, and disclosure of your personal information as described in this Privacy Policy. Please also review the [Terms and Conditions of Services], which govern your use of the Services and any content you submit to the Services.
1. INFORMATION WE COLLECT
A. Information about You that You Provide via the App.
We, and our vendors, may obtain personal information that you provide to us directly. Personal information we, and our vendors, collect may include your name, account credentials, email address, phone number, your business contact information, and your vehicle identification number.
We and our vendors may use a variety of tracking technologies that automatically or passively collect information from you when you use the App. This type of usage information may include such the mobile device that you are using, your IP address, device ID, other unique identifiers, and geolocation data.
B. Information Collected from the Device.
The Device includes a SIM card that will connect to a cellular network operated by a third-party wireless carrier. Through the Device, we may collect the location of your vehicle, sometimes precisely. We may also collect details about your vehicle such as information about the vehicle’s operation, your driving behavior information (such as whether your seat belt is connected), and data-driven diagnostics (e.g., tire pressure of the car).
The Services may be personalized based on various information we may have about you to provide you with more location-relevant content. We may use GPS (global positioning systems)software, geo-filtering, and other location-aware technologies to locate you, sometimes precisely, for purposes such as verifying your location. If you have enabled GPS or use other location-based features on the Services, your location may be tracked by us and third parties.
If you submit the personal information of another person, you represent that you have obtained the authorization from that person to submit such personal information to us. SECRET OR NONCONSENSUAL USE OF THE SERVICES TO COLLECT OR TRACK INFORMATION OF OTHERS IS PROHIBITED. IT IS YOUR RESPONSIBILITY TO NOTIFY ANYONE WHO USES A VEHICLE WITH A DEVICE THAT LOCATION AND DATA COLLECTION FEATURES ARE ACTIVE AND ALLOWS YOU TO ACCESS INFORMATION ABOUT THE VEHICLE, INCLUDING ITS LOCATION.
2. APP PERMISSIONS
Depending on your mobile device or App permission settings, the App may have access to the following information from your mobile device:
1) Location (may include precise or approximate location)
1) Stored information and photos/media/files (the App may be able to read, modify, or delete the contents of your USB storage)
2) Camera (may allow the App to take pictures and videos)
3) Microphone (may record audio)
4) Phone (may directly call phone numbers)
5) Otherinformation (for example, the App may be able to receive data from the Internet, pair with Bluetooth devices and access Bluetooth settings, view your network connections, obtain full network access, and run at startup)
6) Contacts (we allow importing contacts from your phone as drivers in the app)
These App permission settings allow you to access or use certain features within the App. By changing your App permission settings, you may affect your ability to access or use certain features on the App.
Additionally, you may be able to log into the App using your mobile device’s log in features such as using a passcode or through biometric authentication which can include facial recognition or fingerprint matching. These mobile device log in features are facilitated through your mobile device and not 1898 Ventures and we have no control over such features, which you can change by accessing your mobile device settings and preferences.
3. HOW WE USE THE INFORMATION WE OBTAIN
We use your information for many purposes, such as to: (i) improve the Services; (ii) provide the Services to you; (iii) analyze trends and conduct research about the Services; (iv) provide support and respond to questions from users; (v) learn about users’ needs; (vi) address information security and/or privacy issues, network functioning, and troubleshooting with the Services; (vii) comply with applicable laws, regulations, or legal process as well as industry standards and our company policies; (viii) prevent, investigate, identify, or take any other action with regard to suspected or actual fraudulent or illegal activity, or any activity that violates our policies; (ix) investigate claims and/or legal actions, violations of our policies and procedures, and compliance with relevant applicable laws and legal process related to the Services; and (x) for any other purpose, with your consent.
4. INFORMATION WE SHARE WITH THIRD PARTIES
We may share information we collect about you with our subsidiaries and affiliates. 1898 Ventures’ agents, vendors, consultants, and other service providers may receive, or be given access to, your information in connection with their work on 1898 Ventures’ behalf such as to help us operate our business and the Services or administer activities on our behalf.
We may share your personal information in the event we sell or transfer all or a portion of our business assets (e.g., further to a merger, reorganization, liquidation, or any other business transaction), including negotiations of such transactions.
Information, including personal information, may also be shared: (i) as permitted by law; (ii) where we determine that disclosure of specific information is necessary to comply with the request of a law enforcement or regulatory agency or other legal process; or (iii) to enforce our policies, or to protect legal rights, property, or safety.
We may use and share aggregated, non-personally identifiable information. For example, we may aggregate non-personally identifiable information to show trends about the general use of our Services.
5. EXTERNAL LINKS AND FEATURES
The App may contain links to, or features facilitated by, other online services. We are not responsible for the privacy practices, advertising, products, or content of online services that 1898 Ventures does not control. Please note that other online services have their own privacy policies 1898 Ventures is not responsible or liable for these policies
6. CHILDREN’S PRIVACY
The Services are intended for a general audience and not directed to children under 13 years of age. 1898 Ventures does not intend to collect personal information as defined by the U.S. Children’s Online Privacy Protection Act (“COPPA”) (“Children’s Personal Information”) in a manner that is not permitted by COPPA. If we obtain actual knowledge that we have collected Children’s Personal Information in a manner not permitted by COPPA, we will remove such data to the extent required by COPPA.
7. YOUR CHOICES
A. Accessing and Changing Your Information; Communication Preferences.
If you have a registered account with the App, 1898 Ventures may allow you to delete, correct, or update your information by contacting us at
B. Location Tracking.
You may be able to enable or disable location tracking by adjusting the permissions in your account settings in the App or in your mobile device. Note that this action will not disable the geolocation data tracking from the Device
C. Mobile App.
You may be able to exercise specific privacy choices, such as enabling or disabling certain features (
location-based services, push notifications, accessing calendar/contacts/photos, etc.), by adjusting the permissions in your mobile device and/or the App’s settings. Beware that if GPS precise location services are disabled, other means of establishing or estimating location (
If you no longer want to provide us with information through the App, you may uninstall it from your mobile device. Note that this action will not delete your user account or any information we previously collected via the App nor does it affect the information collected from the Device.
8. SECURITY
We maintain appropriate administrative, technical, and physical safeguards designed to help protect personal information collected or received from the Services. Although we use reasonable efforts to safeguard information, transmission via the Internet is not completely secure and we cannot guarantee the security of your information collected through the Services.
9. CHANGES IN POLICY / QUESTIONS
